LEGAL TERMS OF THE "MOTHER'S DAY DRAW 2025" PROMOTION

1. Identification of the organizing company.

The promotion "MOTHER'S DAY DRAW 2025" is organized and executed by the commercial entity "GELT CASH TRANSFER, S.L.U.", with registered office at Calle Pajaritos, 24, 28007, Madrid (Spain) and provided with Tax ID No. B-88506191 (hereinafter, "SENDITY" or the "Organizer").

2. Purpose of the Promotion.

The purpose of this promotion, entitled "MOTHER'S DAY DRAW 2025" (hereinafter, the "Promotion") is to encourage the use of Sendity's remittance service (hereinafter, the "Platform") among users. Participation in the Promotion is free of charge, and will benefit the winner with a free remittance amounting to €300 (applied as a discount in account), under the conditions that will be detailed below. The Promotion is available only for users registered on the Sendity platform who have completed their KYC (Know Your Customer) process.

3. Scope.

Temporal: The start date of the Promotion will be 05/05/2025 at 00:01 and will end on 30/05/2025 at 23:59. The Organizer, however, reserves the right to postpone or extend the participation period in the promotion in case of force majeure.
Territorial: The territorial scope of the Promotion is the entire territory of the European Union in addition to the following Latin American countries: Argentina, Bolivia, Brazil, Chile, Colombia, Costa Rica, Dominican Republic, Ecuador, El Salvador, Guatemala, Honduras, Mexico, Nicaragua, Panama, Peru, Uruguay, Jamaica, Haiti, and Venezuela.

4. Rules and conditions for participation.

The following may participate in this Promotion:
- Natural persons over eighteen (18) years of age, at the beginning of the Promotion and registered with SENDITY.
- Users registered on the Sendity platform who meet the following conditions:
  - Have the KYC (Know Your Customer) process validated.
  - Send a minimum amount of €100 to any of the available destinations (except Cuba) with Sendity during the promotional period (from May 5 to May 30, 2025).
  - Each user can accumulate multiple entries in the draw, obtaining one entry for each remittance of minimum €100 made during the promotional period. There is no limit to the number of entries that a single user can accumulate, which is directly proportional to the number of valid remittances made.
- Participants expressly undertake to guarantee the accuracy and truthfulness of their personal data.
- Participants must expressly accept the legal terms of this Promotion.
The following may not participate in the Promotion:
- Minors under eighteen (18) years of age at the time of commencement or entry into force of the Promotion.
- Employees or family members up to the second degree of consanguinity of the Organizer or participating companies, the advertising agencies involved in the Promotion, suppliers who may be related to the Promotion, as well as any person who is directly or indirectly related to the Organizer or involved in the implementation of this Promotion.
- Those users who have more than one profile in Sendity, i.e., users who have several accounts under the same ownership but with different emails or mobile phones.
- If the transaction is not carried out based on the minimums established in the purpose of this promotion, that is, if the user attempts to make a remittance for an amount less than 100 euros.

5. Mechanics of participation in the Promotion.

To be eligible for the draw, participants who have complied with the rules and conditions set out in the previous section:
- Will automatically participate by making a remittance of minimum €100 through the Sendity platform during the promotional period (from May 5 to May 30, 2025).
- Each participant will receive one entry in the draw for each remittance of minimum €100 made during the promotional period (from May 5 to May 30, 2025). The more remittances made, the greater the chances of winning.
Participants may not infringe in the development of this Promotion the regulations that may be applicable, nor perform acts or omissions that affect or infringe the rights of third parties.
Comply with the mechanics of the Promotion in the manner described in the following clauses, complying with the requirements established in these legal terms.

6. Selection of the winner and prize delivery.

The draw will be held on June 2, 2025, through the App-sorteos.com platform, which allows the import of data via CSV and generates a certificate of the draw.

1 winner and 2 substitutes will be selected in case the winner does not accept the prize, renounces it, or does not meet the requirements established in these terms. In addition:

At the time of the draw, all entries accumulated by all users will be included, taking into account that each remittance of minimum €100 made during the promotional period equals one entry. This means that users who have made more remittances during the promotional period will have more chances of winning the draw.
The winner will be notified by email on June 3, 2025.
The winner will have a period of 7 days from the notification to accept the prize. In case of not receiving a response within said period, the first substitute will be contacted. If it is also not possible to contact the first substitute within 7 days, the second substitute will be contacted.
In the event that the email is erroneous or invalid, or if after 7 days from the first notification attempt no response is obtained from the winner, it will be understood that the winner has renounced the prize and the first substitute will be contacted following the same procedure.

The prize will consist of a free remittance amounting to €300, which will be applied as a discount in the winning user's account. The winner will have a period of 30 days from notification to redeem the prize.

Any attempt by a participant to misuse this Promotion using several/different identities, registrations, entries, and/or any other method will void and disqualify the customer from receiving the Promotion without prior notice.

Sendity reserves the right to modify or cancel the promotion at any time without prior notice.

The company is not responsible for errors in contacting the winner due to incorrect data provided by the user.

Participation in the draw implies full and unconditional acceptance of these legal terms.

7. Penalties in case of fraudulent use.

Compliance with these legal terms and/or the terms and conditions of the Platform by the participants in the Promotion may be verified by the technical means at SENDITY's disposal, which reserves the right to carry out any verification it deems necessary.

Similarly, any false declaration, fraud, indications of false identity or address, or infringement of third-party rights, will result in the immediate disqualification of the participant. In addition, it may entail, where appropriate, the return of the Prize if it has already been obtained. Participants will not implement any method of participation that does not comply with these legal terms.

We will understand as fraud the use of independent platforms or applications to get more participations in the Promotion, as well as behaviors that we detect as apparently abusive and/or malicious.

The finding of any of these practices will result in the disqualification of participants in the Promotion who we consider have arrived through non-permitted channels.

SENDITY reserves the right to take legal action against those who perform any type of act that may be considered as manipulation or falsification of the Promotion.

SENDITY is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of operation of the Platform through which one participates in the Promotion and to the defrauding of the utility that users may have attributed to it.

Likewise, SENDITY will at all times be entitled to withdraw or disqualify participants who (i) do not comply with the rules of the Promotion, (ii) violate good uses and customs or (iii) manipulate or attempt to manipulate the Promotion; (iv) violate any of the conditions of these legal terms or the terms and conditions of the Platform and/or (v) abuse, threaten or harass any participant or third party.

SENDITY may adopt the necessary decisions for the resolution of controversies and conflicts that arise in the development of the Promotion, provided that these do not unduly harm the participants and are equitable.

8. Intellectual and industrial property rights.

All participants in the Promotion guarantee that they are holders of all rights, both intellectual and industrial property of the comments and publications made within the framework of the same, if applicable. SENDITY will not be responsible for any breach of any rule, or any infringement of third-party rights made by participants in the framework of the Promotion, assuming these the obligation to indemnify SENDITY in case of a claim made by said third parties.

Participants assign to SENDITY, on an exclusive and free basis, universal territorial scope, for the maximum period allowed by law and with the power to assign to third parties, all intellectual property rights over the contents and comments published in the framework of this Promotion, for their exploitation in any medium or by any form, including, in particular but not limited to, for the improvement of the Platform, with participants being responsible for the peaceful enjoyment and use of such rights.

In particular and without limitation, participants assign to SENDITY, with the characteristics and limits set out and with the power to assign to third parties, the rights of reproduction, fixation, distribution, public communication and transformation of the contents and comments published in the framework of this Promotion, if applicable.

The assignments made in this section are made free of charge, not giving rise to any consideration. Consequently, the participants of the Promotion may not demand any consideration or oppose its use, except by expressly and in writing renouncing their participation in the Promotion.

9. Reservations and limitations.

SENDITY is exonerated from all liability in case of malfunction of electronic communication networks that prevent the normal development of the Promotion for causes beyond their control and especially for external acts of bad faith. Nor will it be liable for transmission problems or loss of data not attributable to SENDITY.

Any abusive or fraudulent use by participants will give rise, as established in section 7 of these legal terms, to the consequent disqualification of the participant in the Promotion. If the improper use of the Platform (with or without intent to defraud) causes its malfunction, SENDITY will be exonerated from all liability, and may cancel the Promotion.

Similarly, it will be understood, by way of example but not limitation, that abuse or fraud occurs when a participant makes a remittance using a false identity or identities of third parties without their consent.

SENDITY is not responsible for possible losses, deterioration, delays or any other circumstance attributable to third parties that could affect participation in this Promotion.

SENDITY is exempt from any liability in the event that there is any error in the data provided by the participants themselves that would prevent their identification or the delivery of the Prize.

SENDITY reserves the right to make changes that result in the good end of the Promotion when there is just cause or force majeure that prevents it from being carried out in the manner set out in these legal terms.

SENDITY reserves the right to make modifications or add successive annexes on the mechanics and incentives of this Promotion provided that they are justified or do not harm the participants, and are duly communicated to them.

In the event that this Promotion could not be carried out, either due to detected fraud, technical errors, or any other reason that is not under the control of SENDITY, and which affects the normal development of the same, SENDITY reserves the right to cancel, modify, or suspend it, without the participants being able to demand any responsibility from SENDITY.

SENDITY is exempt from any liability in the following cases:

In the event that the participants' data is incomplete, or is erroneous.

It is recommended that participants, before providing any data on the Platform, carefully read its terms and conditions.

SENDITY is not responsible for possible data losses due to email problems or drops, if applicable, of the Platform, nor for any malfunction or temporary suspension of electronic communication networks that prevent the normal development of the Promotion.

For causes not attributable to SENDITY.

SENDITY is not responsible for the impossibility of contacting the participant, nor for the impossibility of delivering the Prize because the personal data provided by the participant is incorrect or incomplete.

SENDITY is not responsible for possible losses, deterioration, theft, delays or any other circumstance that is not attributable to it, nor will it respond to cases of force majeure (such as strikes, riots, wars, rebellions, insurrections, acts of terrorism, pandemics, epidemics, earthquakes, floods, equipment explosion, among others) that could prevent the participant from fully or partially enjoying their Prize, being exempt from all liability in any of the aforementioned cases or any other similar.

For the contents:

Each participant will be responsible for the content and information published at the time of evaluating the Platform.

More specifically, the participants of the Promotion, at the time of evaluating the Platform:

Acknowledge that they have the right to freely transmit the information provided.
Acknowledge that the information transmitted by them does not infringe any intellectual or industrial property right, commercial, business or professional secret, confidentiality contractual clause, data protection right or information society right, or any other right of third parties.
Acknowledge that the transmitted information is not confidential and is not harmful to third parties.
Acknowledge assuming full responsibility, holding the Organizer harmless for any information they provide personally, with such responsibility extending, without any restriction, to the accuracy, legality, authenticity and ownership thereof.

In view of the above commitments and guarantees, the Organizer will not be responsible for the information and data that the participant may disseminate and publish.

10. Cancellation, modification or suspension of the Promotion.

SENDITY reserves the right to modify at any time the conditions of the Promotion, even to suspend or cancel it before the predetermined period, provided that there is just cause, undertaking to communicate the new legal terms, conditions of the Promotion or the definitive cancellation, if applicable, with sufficient notice and publicity.

Likewise, SENDITY reserves the right to postpone or extend the period of the Promotion, as well as the power to interpret these legal terms.

Any suspension, postponement, cancellation or modification of the Promotion will be announced by emt may at any time update or modify the information provided when there are errors in the content provided to SENDITY, or when the information or data has changed since it was initially provided.

13. Applicable legislation, jurisdiction.

This Promotion is governed by current Spanish legislation.

Participation in this Promotion implies knowledge and acceptance of these legal terms.

The knowledge and resolution of any litigation, discrepancies, controversies or differences that may arise in relation to the interpretation, content or resolution of these legal terms, will be submitted to the jurisdiction and competence of the Courts and Tribunals corresponding to the city of the participant's domicile, as a consumer.

14. Acceptance of the legal terms.

Participation in the Promotion implies the acceptance of these legal terms. Any manifestation of non-acceptance of all or part of the legal terms implies the exclusion of the participant and, as a consequence, SENDITY will be released from fulfilling the obligation contracted with this participant.

In any case, if it is detected that any participant has engaged in fraud, SENDITY reserves the right to exclude them or not deliver the Prize that might have corresponded to them. In addition, SENDITY reserves the right to remove from the Promotion any participating user who is suspected of irregular action, without any notification to the same. SENDITY intends for all participants to take part in the Promotion on equal terms and with strict respect for the laws, morals, public order, or generally accepted social norms.

11. Protection of personal data.

In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, "GDPR"), as well as the Organic Law 3/2018, of December 5, on Protection of Personal Data and guarantee of digital rights (hereinafter, "LOPDGDD"), for the specific processing of personal data to be carried out by SENDITY, it is necessary that the participant gives their active, free and informed consent on the processing of their personal data.

This processing of personal data, independent of the treatments that SENDITY normally performs (and which can be consulted in its Privacy Policy), is specific for the participants of the Promotion who accept it.

Purposes: Participation in the Promotion "MOTHER'S DAY DRAW 2025", delivering the Prize to the winner and analyzing the use and impact of SENDITY services on its users.

Data collected:

Name and surname of the customer; postal address; phone number, email address; card number with which the transaction payment is made.
Name and surname, address, phone number and bank account number of the recipient.

Legal basis: The legal basis for the processing of your personal data is the consent of the data subject and compliance with the legal terms of the Promotion.

Recipients. SENDITY will not transfer your data to third parties, except for compliance with legal obligations to which we are obliged (Public Administrations, financial entities, insurers).

Data retention: The data collected and provided will be kept for the minimum time necessary for the purposes authorized for participation in the Promotion. If you consider that the processing does not comply with the current data protection regulations, you have the right to file a complaint with the supervisory authority (Spanish Data Protection Agency) at www.aepd.es, although it is SENDITY's commitment to guarantee the privacy and security of the data and to resolve internally any issue related to them.

In addition, the participant has the possibility and the right to withdraw consent for any specific purpose granted at any time, without affecting the lawfulness of the processing based on consent prior to its withdrawal.

12. Miscellaneous.

If a Court or competent administrative body determines that any of the legal terms is invalid, illegal, null or voidable, it will be removed from this document, without affecting the rest of the sections contained therein. The remaining sections will remain in force in all their terms, to the extent possible.

The participant may at any time update or modify the information provided when there are errors in the content provided to SENDITY, or when the information or data has changed since it was initially provided.
